Contractual Relationship

These Terms of Use ("Terms") oversee your access or use, from within the United States and its regions, of KABOU TECHNOLOGIES INC. platform and any associated content or services (collectively, the “Services),” made available in the United States and its regions by KABOU TECHNOLOGIES INC. Technologies, and its businesses, representatives, affiliates, PLEASE READ THESE TERMS CAUTIOUSLY, AS THEY ESTABLISH A LEGAL AGREEMENT BETWEEN YOU AND KABOU TECHNOLOGIES INC. In these Terms, the words "including" and "include" mean "including, but not limited to".

By get into or using the Services, you approve your agreement to be assured by these Terms. If you do not agree to these Terms, you may not access or use the Services. These Terms specifically replace prior agreements or arrangements with you regarding the use of the Services.

Nevertheless, the preceding, these Terms do not replace or otherwise impact the validity of any agreements you may have with KABOU TECHNOLOGIES INC. or its businesses regarding driving, delivering and/or providing transportation and/or delivery services (e.g., the Platform Access Agreement, the Technology Services Agreement and/or any similar agreements). To the level (but only to the level) any agreement you may have with KABOU TECHNOLOGIES INC. regarding driving, delivering and/or providing transportation and/or delivery services conflicts with these Terms, those agreements (and not these Terms) will exist.

KABOU TECHNOLOGIES INC. may directly terminate these Terms or any Services with respect to you, or generally stop offering or reject access to the Services or any portion therefrom, at any time for any purpose.

IMPORTANT: PLEASE BE ADVISED THAT THIS AGREEMENT COVERS REQUIREMENTS THAT OVERSEE HOW CLAIMS BETWEEN YOU AND KABOU TECHNOLOGIES INC. CAN BE CARRIED, INCLUDING THE ARBITRATION AGREEMEN. PLEASE REVIEW THE ARBITRATION AGREEMENT BELOW CAREFULLY, AS IT NEEDS YOU TO RESOLVE ALL DISPUTES WITH KABOU TECHNOLOGIES INC.ON AN INDIVIDUAL BASIS AND, WITH LIMITED EXCLUSIONS, THROUGH FINAL AND REQUIRED ARBITRATION. BY ENTERING INTO THIS AGREEMENT, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND ALL OF THE TERMS OF THIS AGREEMENT AND HAVE TAKEN TIME TO CONSIDER THE COSTS OF THIS IMPORTANT DECISION.

Any changes made by KABOU TECHNOLOGIES INC.to these Terms from time to time. If KABOU TECHNOLOGIES INC. you will be provided with notice of such changes, such as by sending an email, providing a notice through the Services, or updating the date at the top of these Terms. Unless KABOU TECHNOLOGIES INC. says otherwise in its notice, the revised Terms will be effective immediately and your continued access to and use of the Services after KABOU TECHNOLOGIES INC. provides such notice will authorize your receiving of the changes. If you do not agree to the revised Terms, you must stop accessing and using the Services.
